What requirements do you have to meet as a tenant of De Woningstichting?
• As a tenant of De Woningstichting, you must leave behind an independent home that you are currently renting from De Woningstichting.
• This applies to tenants of a single-family home but also to an apartment owned by De Woningstichting.
This does not apply to a live-in tenant. If you live in a rental property from De Woningstichting, but you are a resident, you will not leave a home behind and you will not have priority, but you can schedule an appointment after the 4-week period.

IMPORTANT CLAUSES IN THE PURCHASE AGREEMENT:
• Article Self-occupancy obligation and anti-speculation clause
1. The Buyer undertakes to De Woningstichting that he will actually occupy the Sold Property as the main resident. He undertakes not to alienate or rent out the Sold Items to third parties or otherwise transfer the use of them, except as stated in the following paragraphs.
In this article, occupancy by first-degree relatives by blood or marriage of the Buyer is materially equated with private occupancy.
Alienation also includes allocation and the establishment of a limited commercial right of use.
2. The provisions of paragraph 1 do not apply in the event of:
a. execution sale on the basis of Article 268, Book 3 of the Civil Code;
b. sale on the basis of a court authorization as referred to in Article 174, Book 3 of the Civil Code;
c. written exemption as referred to in paragraph 4 sub a.
3. The provisions of paragraphs 1 and 2 lapse after the Buyer has occupied the Sold for five (5) consecutive years. The benchmark is the date on which and the time during which the Buyer is registered as a resident of the relevant address in the Municipal Personal Records Database.

4. a. The Housing Association may grant a written exemption from the provisions of this article for the alienation of the Property Sold.
b. The exemption from alienation is always granted in the case of:
1. change in Buyer's work environment that reasonably necessitates relocation;
2. death of the Buyer or his spouse or partner;
3. dissolution of the Buyer's marriage or dissolution of a registered partnership;
4. relocation necessitated by the health of the Buyer or one of his family members.
c. In the event of exemption by the Housing Foundation, the period referred to in paragraph 3 will be deemed to be continued by the new acquirer.
5. If, in the event of an exemption by De Woningstichting, the Buyer proceeds with the complete or partial alienation of the Property Sold for the benefit of others than De Woningstichting, he is obliged to provide the provisions of this article, as well as the provisions of this paragraph, to his legal successor(s). to impose and to stipulate for and on behalf of De Woningstichting, failing which he will owe De Woningstichting an immediately payable fine to be determined by De Woningstichting, subject to mitigation by the court, of a maximum of one hundred percent (100%) of the price for which he obtained the Sold Property from the Housing Foundation.
This obligation ends if and as soon as the period referred to in paragraph 3 has expired, after which the article 'self-occupation' no longer needs to be included in subsequent deeds.
• Article Cadastral measurement
Cadastral measurement of the plot sold here still needs to take place. The actual size of the plot will become apparent after cadastral measurements. The costs for cadastral measurements are borne by the seller.
• Article Non-self-occupancy clause / Actual use:
The buyer is aware that the seller has never actually used the sold item himself and that the seller therefore cannot inform the buyer about properties or defects of the sold item that the seller could have been aware of if he had actually used the sold item himself. In connection with this, the parties, notwithstanding Article 6.3. of this deed of sale and Article 7:17 paragraphs 1 and 2 of the Dutch Civil Code, it has been agreed that such properties or defects are at the expense and risk of the buyer and that this has been taken into account when determining the purchase price. The buyer indemnifies the seller against any claims from third parties.
• Buyback protection:
The apartment is located in De Bovenbuurt, where the purchase protection applies.
As of February 17, 2022, the municipality of Wageningen will introduce purchase protection. This means that a home may not be purchased and then rented out. Anyone who buys the home must, in principle, live in it themselves (self-occupancy obligation). The purchase protection does not apply to all neighborhoods in Wageningen nor to all price ranges. It only applies to houses with a WOZ value less than € 405,000 (NHG value limit) in the districts: Inner City/Centre, Boven- en Benedenbuurt, De Buurt-West and de Nude.
The national Purchase Act obliges municipalities to make a number of exceptions. These still make it possible to rent out the owner-occupied home. These exceptions are:
- Rental to 1st or 2nd degree family members. For example, your son or daughter. Or brother or grandchild.
- Rental for a maximum of 1 year if you have been living in the home for 12 months or longer. For example, if you go abroad for a year.
- Rental of living space located in a shop, office or business premises.

• Article Old age clause:
The buyer is aware that the property was originally built in 1957, which means that the requirements for construction quality are considerably lower than for new homes. Notwithstanding Article 6.3. of this purchase deed and Article 7:17 paragraphs 1 and 2 of the Dutch Civil Code, the complete or partial absence of one or more properties of the immovable property for normal and special use and any other failure of the property to comply with the agreement is for the account and buyer's risk.
• Article Asbestos:
Asbestos-containing substances/materials may be present in the immovable property. If these are removed, the buyer must take measures and facilities as prescribed by legislation. The buyer declares that he is familiar with this legislation and accepts all liability and consequences that may arise from the presence of asbestos and/or the removal of asbestos from the immovable property. Notwithstanding Article 6.3. of this purchase deed and Article 7:17 paragraphs 1 and 2 of the Dutch Civil Code, the complete or partial absence of one or more properties of the immovable property for normal and special use and any other failure of the property to comply with the agreement is a result of the presence of any asbestos in any composition and/or in any location at the expense and risk of the buyer.
