Start of sales phase 2
The sale of phase 2 started on Thursday, September 26, 2024. This phase consists of 63 apartments for sale in one of the four buildings: Bok B. These are apartments with one, two, three or even four rooms. The living areas range from approximately 39m2 to more than 109m2. Prices range from about € 350,328 to about € 726,762. These prices are freehold and based on canon payment.
Facilities
All buildings of Roof Garden share an underground bicycle parking basement, which is located under Block B, with separate spaces for sale for cargo bikes and scooters. Some commercial spaces are planned on the first floor, for such things as a coffee bar, a community room and healthcare providers.
Self-occupancy obligation
All apartments are subject to a self-occupancy obligation as applies to many newly built owner-occupied homes in Amsterdam: it is not permitted to rent out owner-occupied apartments unless prior permission has been obtained from the municipality and only in the following cases;
a. Renting out the apartment to a family member in the first degree;
b. For a limited period of time when demonstrably staying abroad.
c. Renting out the apartment for a total rent that does not exceed the limit for medium-term rent.
The full scope of the obligation to live in the apartment yourself and the exceptions are set out in the general provisions (AB2000) and the special provisions that accompany the sales contract.
The explanation below concerns information about types B01 (1x), B05 (25x), B05* (1x) and B16 (25x), the affordable owner-occupied apartments (studios).
Sales price
- These types of apartments fall within the 'social owner-occupied housing' category defined by the City of Amsterdam. This is subject to a number of additional conditions;
- Building numbers with this type are sold at a maximum sales price of €405,000, - (including 50-year leasehold canon) price level January 2025.
- This maximum sales price includes VAT or transfer tax, land registry fees, notary fees and the ground lease buy-off fee.
- This type of apartment is delivered including kitchen.
- The property may only be purchased by buyers/end users (residents) who are natural persons, not legal entities.
- Buyer/end user has the choice of annual ground rent payment or redemption.
- If annual ground rent payments are chosen, the selling price (including the 50-year ground rent waiver) will be reduced by the ground rent waiver sum that belongs to the 50-year waiver. The sales price with annual canon payment does include a 2-year canon amount.
- If the municipality of Amsterdam decides to lower the maximum sales price before 2025, the sales price will be adjusted downwards for both canon payment and 50-year bought-off ground lease.
- If the Municipality of Amsterdam decides to increase the maximum sale price before 2025 then the sale price will not be adjusted for both canon payment and 50 years bought off leasehold.
- The seller reserves the right to reset the sales prices for these types of homes with delivery starting January 1, 2026 in accordance with the municipality's policy.
Anti-speculation clause
- These apartments are sold with anti-speculation clause with the aim of preventing resale of apartments within the stipulated period (5 years) after construction completion.
- The clause takes effect at a sales price above a set threshold.
- This is for a sales price from €430,000 for a 50-year bought-off canon and from €385,000 for an annual canon, excluding taxes.
- For sales in the first year after construction completion, you will pay 100% of the capital gain (the difference between sales price excluding taxes minus the threshold value). For the entire second year after completion, 80% of the capital gain applies, the third year after completion 60%, etc. This clause decreases to 0% in five years.
